While the U.S. Department of Justice strengthens mutual monitoring of government agents, the Korean Ministry of Justice will lead the personnel verification system that strengthens prosecutors' information-gathering powers.
The U.S. Department of Justice updated its policy to contain the use of force for the first time in 18 years, distributing Department of Justice instructions to federal law enforcement officers last Monday that they are obligated to intervene if they see excessive use of force by other law enforcement officers. The Washington Post reported.
Attorney General Merrick Garland's new policy expanded the government's responsibility for human rights violations from the system that applied whether or not to violate the 'internal ordinance' for excessive acts of 'public power' and expanded the internal monitoring system for the administrative execution of public officials.
On the other hand, the Ministry of Justice under the Yoon Seok-yeol system introduced a new system in which prosecutors and police inspect personnel through personnel information in the personnel information management team.
On the 24th, the Ministry of Justice, the Ministry of Human Resources Innovation, and the Ministry of Public Administration and Security announced the legislative notice of some amendments to the 'Regulations on the Collection and Management of Information on Candidates for Public Offices' by Presidential Decree.
The presidential office said on the 25th to Yonhap News, "there are some similarities between the advanced personnel verification system of the United States and the personnel information management team system."
In the United States, the independent FBI (Federal Bureau of Investigation) mutually verifies the criminal record of candidates for public office commissioned by the White House Office of Counsel, and the White House decides and announces them.
Under the Yoon Seok-yeol system, the Ministry of Justice is led by prosecutors and police in the newly established personnel information management team, and the ‘social sector’ (in charge of 1) and ‘economics’ (in charge of the 2nd officer) are in charge of both information collection and analysis conclusions.
Rep. Jang Je-won (former chief of staff), a close aide to the president, posted on Facebook on the 25th, "It would be good to have an official personnel verification department at the National Intelligence Service." "President Yoon wanted to hear the reputation of the person through various channels." In addition, personnel verification strengthened the reliance on intelligence agencies-led information gathering.
The Ministry of Justice's personnel information management team is expected to undermine "political neutrality of prosecutors" and "court independence" by overseeing personnel from the court, including the Chief Justice of the Supreme Court, the Prime Minister and the executive branch, as well as personnel from the National Intelligence Service and the 3rd military organization.
When the Presidential Decree is passed, the authority to collect and manage personal information on candidates for public office in the Ministry of Personnel Management and Innovation is entrusted to the Minister of Justice, including the head of the Presidential Secretariat. There are 20 people (up to 4 prosecutors, including 2 police officers), and 2 officers (economy) are led by the prosecutor's office.
