Lee Jae-myeong's 'repeated investigation' violates political party law, destroys 'democratic order' in election campaign of close associates

Lee Jae-myeong, leader of the Democratic Party of Korea, violated the Political Party Act by flaunting his monopoly on ‘repeated investigation’ authority in candidate selection, saying, “Repeatedly investigating which person is superior is the basis of elections and the daily behavior of political parties.”

Representative Lee's re-emergence of the public opinion polling company that he used when he was Mayor of Seongnam and repeated telephone public opinion polls without the names of incumbent lawmakers constitutes an illegal election campaign in which the names of specific, unknown people he supports are disseminated with party funds.

The method of excluding specific people and repeatedly asking questions about their names in emergency telephone polls, which began in the United States, is an election campaign based on publicity of a person, and if a political party takes the initiative without reporting it to the National Election Commission, it becomes illegal execution of election funds.
The Political Party Act states, <Article 29 (Organization of Political Parties) ① In order to maintain democratic internal order, a political party must hold a general meeting of its members if it has a representative body and executive body that can reflect the consensus of its members and affiliated National Assembly members.> It stipulated that a general meeting of members be held based on ‘candidate recommendation’ and ‘party member consensus’.
The 'repeated investigation' that Representative Lee flaunted falls under 'political party activities' under Article 37 of the Political Party Act <Policy of the party without supporting, recommending or opposing a specific political party or candidate for public office election (including those who wish to become a candidate)> This violates the ‘democratic fair treatment of candidates’ under the Political Party Act.
Representative Lee actively attempted to ‘campaign for his preferred candidate’ through ‘repeated investigations’ excluding active members or specific people, and admitted to violating the law by saying, “The rules have already been set.”
Regarding the number of people leaving the party due to the unfair nomination screening, Representative Lee said on the 28th, "I will not play because I feel like I will lose if I play," and added, "I think there are one or two people who have left the party recently. They are free to join the party and they are free to leave the party." .
Representative Lee said that Article 35 of the Political Party Act appears to exclude the reporting of ‘activities’ due to the ‘candidate selection survey commissioned by a specific agency’, which was actively attempted last year, from the ‘obligation to report the number of party members and activities at the end of the year and the activities to the National Election Commission in February of the following year’.
Political Parties Act <Article 35 (Regular Reporting) ① The Central Party and city/provincial parties manage the elections under their jurisdiction by reporting the number of party members and activity status as of December 31 of each year until February 15 of the following year (January 31 for city/provincial parties). Must report to the committee. In this case, it was stipulated that the Central Party must report to the National Election Commission the contents of policy promotion for the current year, the results of the promotion, and major policy implementation plans for the following year.
In response to criticism of the process of selecting a public opinion poll company, Representative Lee said, "It is due to misunderstanding and exaggeration." He added, "For strategic judgment, it is important to repeatedly investigate what the topography of the region is and which candidate is superior among the candidates in the election. It is the basic and daily behavior of a political party,” and “you can complain and be dissatisfied, but it is only an investigation,” he said.
Regarding the election of candidates, Representative Lee said, "We must give new people a chance as well," and "Just as a river flows to the sea, there must be a generational change and new opportunities must be given. In particular, it is essential to select players who meet the expectations of our people. "By emphasizing the 'representative' 'Central Party's 'monopoly on player selection rights', it violated the 'maintenance of democratic order' provision of the Political Parties Act.

Regarding the actions of 'cut-off', 'deduction of points', 'participation in the primary', and 'no participation in the primary' based on the screening of candidate qualifications as an undisclosed member of the third party, Representative Lee said, "It is not beautiful in the public's eyes to say that you will not play because you feel like you will lose. “I won’t,” he responded with his status as a “screening decision maker.” 

Representative Lee went on to transform himself into a 'game operator', saying, "I am free to compete within the set rules and then give up midway because the rules are unfavorable to me or because it is difficult to win, but it is not right to speak as if there is a problem with the management of the game." I ordered it. 

In particular, Representative Lee said to reporters, "The media should play the role of the media and referee. Shouldn't it be the opponent's player and not only attack, but also distort the facts and take the other side?" He said, "The media is the referee," violating the law of political parties.

Rep. Jeong Pil-mo, who was the chairman of the election committee, said about the resignation of the chairman at the general meeting of lawmakers on the 27th, “In the selection of three opinion poll companies, ‘Research D&A’ was added a day later, and on the 20th, it was reported by the media that this company was conducting ‘opinion polls excluding active lawmakers.’ This was revealed, and the working staff explained that it was not because of the burden of work, but that a third party instructed the subcommittee in question over the phone and inserted it, and the working staff kept silent, saying they ‘cannot reveal’ whose instructions it was.”
In response, Representative Lee said on the 22nd, “What is the relationship between the Seongnam City public opinion poll conducted decades ago and the Democratic Party’s quantitative evaluation?”
On the 23rd, the Democratic Party responded to reports of pro-Myeong faction Senior Vice President Kim Byeong-ki's 'behind the scenes intervention', saying, "Senior Kim expressed the opinion that there may be unfair controversy if a company that was given priority for a company selection presentation is excluded without an appropriate reason." The National Election Commission announced that it had signed contracts with four companies in consideration of the primary election survey work.
