Impeachment bill ‘National Assembly incapacitation’ Yoon’s martial law declaration ‘Democratic Party criticism’ inconsistency

 

 


The impeachment bills of the six opposition parties have a large gap in that while the martial law speech is defined as ‘criticism of the National Assembly,’ the actual speech is written as “the Democratic Party is attempting to overthrow the liberal democratic system.”

The impeachment bill proposed on the 12th clearly states ‘Yoon Seok-yeol’s martial law against the power of the National Assembly with a minority of the opposition party,’ and the ‘proclamation’ sets it as ‘the overthrow of the liberal democratic system from the legislative dictatorship of the Democratic Party,’ showing that each subject is divided into ‘criticism of the National Assembly’ and ‘criticism of the Democratic Party,’ showing mutual inconsistency.

The impeachment bill specifically states only the violation of ‘national sovereignty (Article 1 of the Constitution)’ and excludes the violation of Article 1 of the Constitution regarding the national identity of ‘the Republic of Korea is a democratic republic,’ which is the foundation of the national policy, due to the martial law declaration’s ‘establishment of a liberal democratic system by protecting the free Republic of Korea and eradicating anti-state elements.’

The impeachment bill stipulates that “pro-North Korea anti-state forces” are “referring to the National Assembly,” but the martial law declaration states that “the Democratic Party (omitted) is a legislative dictatorship, even budgetary impeachment (omitted) and attempts to overthrow the liberal democratic system,” so the subjects are different as the “Democratic Party” and the “National Assembly.”

The impeachment bill clearly states that “the exercise of the constitutional right to check the president, such as the impeachment bill by the minority opposition party in the National Assembly created by the people and the cut of major government budgets, is a “clear anti-state act plotting an internal rebellion” and “an attempt to overthrow the liberal democratic system.”

On the other hand, the ‘Martial Law Discourse’ announced on the 3rd clearly stated that “This legislative dictatorship of the Democratic Party, including budget and impeachment (omitted) is clearly an anti-state act that tramples the constitutional order of the free Republic of Korea, disrupts the legitimate state institutions established by the Constitution and law, and is plotting internal rebellion,” and thus clearly stated that “the Democratic Party is anti-state.”

 

The martial law discourse continued by stating that “Our National Assembly has now become a den of criminals, and through legislative dictatorship, they are paralyzing the state’s judicial and administrative systems and attempting to overthrow the liberal democratic system.

 

The National Assembly, which should be the foundation of liberal democracy, has become a monster that is destroying the liberal democratic system,” and defined it as “the Democratic Party’s dictatorial rule of the National Assembly.” The impeachment bill, on the other hand, seems to be erroneous because it states that <the impeached party defines the exercise of the constitutional right to check the president, such as the impeachment bill proposed by the minority party in the National Assembly and the cut of major government budgets, as “clearly anti-state acts plotting internal rebellion” and “attempting to overthrow the liberal democratic system,” and diagnoses that as a result, the “government of the Republic of Korea is paralyzed” and “is in a state of chaos that could collapse at any moment.”

The conclusion of the impeachment bill is <to hide the fact that the unconstitutional and irrational claim of declaring martial law to paralyze the National Assembly due to dissatisfaction with the National Assembly is being forced upon the people, and the ‘North Korean threat’ is suddenly inserted in one line>, and it is explicitly stated as ‘inserting North Korea as an irrational packaging for paralyzing the National Assembly.’

On the other hand, the martial law discourse states, “I declare martial law in order to protect the free Republic of Korea from the threat of the North Korean communist forces, eradicate the shameless pro-North Korean anti-state forces that are plundering the freedom and happiness of our people, and protect the free constitutional order. Through this martial law, I will rebuild and protect the free Republic of Korea that is falling into the abyss of national ruin.” Since “North Korean communist forces” and “eradicate pro-North Korean anti-state forces” are separated in the same sentence, the logic of the “impeachment motion” seems to be arbitrary judgment.

The impeachment motion only states the violation of “national sovereignty (Article 1 of the Constitution)” and excludes the violation of Article 1 of the Constitution regarding the national identity of “the Republic of Korea is a democratic republic” due to the martial law declaration’s “establishment of the free Republic of Korea system by protecting the free Republic of Korea and eradicating anti-state forces.”
