The U.S. Federal Labor Commission has ruled that Amazon's policy of 'prohibiting non-workers from accessing warehouses' is illegal.
Amazon, an American online company, has traditionally prohibited workers from remaining inside the warehouse, including the break room, unless they are within 15 minutes of working a shift.
The Federal Labor Commission ruled on the 22nd that the union, which represented workers at the Staten Island warehouse last year, was illegal on the 22nd of a complaint filed against Amazon's policy of restricting employee access to the warehouse outside of work hours.
The Labor Commissioner, in a written notice to unions on Monday, determined that the regional offices had violated the law by adopting an access rule in response to union activity last summer, and that the rule was applied in a discriminatory manner against union supporters, the New York Times reported. reported on the 23rd.
Amazon labor unions argued that the company's non-working break room warehouse access policy made it difficult for workers to exercise their right to talk to their colleagues about joining or supporting a union, and the Labor Relations Commission accepted.
“The company adopted these rules to protect employee safety and building security,” said Mary-Kate Paradis, an Amazon spokesperson. “People can still access non-work spaces outside of company buildings,” he commented.
"Union organizers attribute the Staten Island warehouse's election victory at JFK8, the union campaign, in part to the ability of off-duty workers to talk to co-workers and distribute food and union materials in break rooms," the NYT said. Not long after the victory, we lost that access last summer, which made it much more difficult for us to reach out to other workers in the warehouse and expand our participation in the pressure campaign to bring Amazon to the negotiating table.”
The Federal Labor Commission earlier reached an agreement with the company to ease policy expansion across the country as the union's JFK2021 campaign was gaining momentum, and the agreement allowed Amazon to re-enact the more restrictive policy months later, but the Labor Commission did not do so. The position is that one method is illegal because it is discriminatory.
