Han Duck-soo’s ‘dismissal’ of the Constitutional sovereignty infringement, People Power Party’s ‘dissolution of the party’ for violating democratic order
Prime Minister Han Duck-soo infringed on the president’s authority as specified in the Constitution, and the People Power Party violated Article 8 of the Constitution’s ‘democratic basic order of political parties’, making him the target of ‘dismissal’ and ‘dissolution of the party’.
On the 8th, Prime Minister Han announced the division of national power through a statement with People Power Party leader Han Dong-hoon, stating, “The president cannot intervene in foreign affairs,” and agreed to Han’s announcement that “we will prepare measures for current issues such as the economy, national defense, and diplomacy through constant communication so that there will be no vacuum in state affairs,” handing over national power to the party and infringing upon it.
Prime Minister Han said in a joint statement with Representative Han that day, “All State Council members, including myself, and public officials of the ministries will put the will of the people first and pool our wisdom with the ruling party to operate all state functions in a stable and smooth manner,” and “We will strengthen the emergency economic response system,” illegally transferring power to the People Power Party through “emergency system activation” without a State Council resolution.
Article 74 of the Constitution states that “the President shall command the Armed Forces as prescribed by the Constitution and laws,” prohibiting arbitrary transfer of command authority of the Armed Forces, and Prime Minister Han and Representative Han violated this on that day.
Article 82 of the Constitution states that “the President’s acts under national law shall be in writing, and the Prime Minister and relevant State Council members shall countersign such documents. The same shall also apply to military matters,” but Prime Minister Han broke and violated this on that day.
Article 89 of the Constitution states that “the State Council must deliberate on matters,” and is a mandatory provision that “1. The basic plan of state affairs and general policy of the government were stated, and after agreeing with the speech of Representative Han at the People Power Party headquarters on that day, the State Council was held and violated.
As a state-supported political party, the People Power Party violated the ‘democratic order’ by infringing upon the authority of the president and the sovereignty of the state as stated in the Constitution without legal grounds.
Article 8 of the Constitution stipulates that <④ When the purpose or activity of a political party is in violation of the basic democratic order, the government may bring a suit for its dissolution to the Constitutional Court, and the political party shall be dissolved by the judgment of the Constitutional Court>, thereby stipulating the dissolution of a political party for ‘violation of the democratic order’.
‘Dismissal of the Prime Minister’ is stipulated in Article 63 of the Constitution as <A motion for dismissal shall be proposed by more than one-third of the members of the National Assembly and approved by a majority of the members of the National Assembly>, making it possible for an early ‘dismissal motion to be passed’.

The ‘subversion of the Constitution’ of the crime of rebellion is a punishment for an act that <annihilates the function of the Constitution or law without following the procedures stipulated in the Constitution or law>, and can be applied to the joint statement of Representative Han and Prime Minister Han.
The crime of rebellion is punishable by up to the death penalty and up to a minimum of 5 years of imprisonment or confinement according to Articles 88, 89, and 91 of the Criminal Act, and attempts are punishable, and preparation, conspiracy, instigation, and propaganda are also stipulated to be punished.
The Constitution separates only military power in Article 73 <The President shall conclude and ratify treaties, accredit, receive or dispatch diplomatic envoys, and declare war and make peace> and Article 74 <The President shall command the Armed Forces as prescribed by the Constitution and laws>, and includes diplomacy in the acting system. Prime Minister Han violated the Constitution by altering this to state that ‘diplomacy and the President cannot be separated.’
The National Assembly’s exercise of power over the Prime Minister is prioritized by the ‘resolution to dismiss’ in Article 63, and the ‘resolution to impeach’ in Article 65, which the Democratic Party is pushing for, transfers the final judgment authority to the Constitutional Court and prioritizes the benefit of ‘immediate suspension from duty,’ so it seems that additional ‘impeachment’ by the ‘resolution to dismiss’ will be advantageous in the Constitutional Court’s ruling on the ‘impeachment of the acting president.’
